    Final Regulation

    REGISTRAR'S NOTICE: The Common Interest Community Board is claiming an exemption from the Administrative Process Act in accordance with § 2.2-4006 A 4 a of the Code of Virginia, which excludes regulations that are necessary to conform to changes in Virginia statutory law where no agency discretion is involved. The Common Interest Community Board will receive, consider, and respond to petitions from any interested person at any time with respect to reconsideration or revision.

    Statutory Authority: § 54.1-2349 of the Code of Virginia.

    Effective Date: July 1, 2010.

    Summary:

    Chapter 557 of the 2009 Acts of Assembly changed the board’s authority as it is applicable to any person licensed or certified by the board who violates any statute or regulation pertaining to the board and who is not criminally prosecuted. The amendment to the regulation reflects the change from § 54.1-2351 H of the Code of Virginia to § 54.1-202 of the Code of Virginia.

    18VAC48-50-140. Grounds for disciplinary action.

    The board may place a regulant on probation, impose a monetary penalty in accordance with § 54.1-2351 H § 54.1-202 of the Code of Virginia, or revoke, suspend, or refuse to renew any license when the regulant has been found to have violated or cooperated with others in violating any provisions of the regulations of the board or Chapter 23.3 (§ 54.1-2345 et seq.) of Title 54.1 of the Code of Virginia.
