    Notice of Intended Regulatory Action

    Notice is hereby given in accordance with § 2.2-4007.01 of the Code of Virginia that the Board of Pharmacy intends to consider amending 18VAC110-20, Regulations Governing the Practice of Pharmacy. The purpose of the proposed action is to consider amendments to the regulation in response to two petitions for rulemaking that were granted by the board. The proposed amendments (i) authorize a pharmacist, when deemed appropriate in his professional judgment and upon request by the patient, to dispense a quantity of a Schedule VI drug in excess of the specific quantity prescribed for a dispensing, not to exceed the total amount authorized in refills and (ii) authorize the use of an automated dispensing device in a nursing home for obtaining drugs that would be stocked in a stat-drug box and clarify the quantity of drugs in Schedules II through V that may be stocked in the device for this purpose. The board will consider the appropriateness of requiring a provider pharmacy to the nursing home to obtain a controlled substances registration at the location of the facility for the purpose of placing an automated dispensing device in the facility. The board's decisions regarding the petitions for rulemaking were published in 33:3 VA.R. 301 October 3, 2016.

    The agency intends to hold a public hearing on the proposed action after publication in the Virginia Register.
