AGENCY SUMMARY
The State Council of Higher Education for Virginia is the coordinating agency for state-supported institutions of higher education. It is authorized to adopt regulations to implement its powers in that capacity. Code of Virginia, Title 23.1, Chapter 2. It is also vested with regulatory authority with respect to some matters not directly relating to, nor restricted to, state-supported institutions.
Contracts between private colleges and public colleges or educational agencies for the provision of services are subject to its approval. Code of Virginia, Title 23.1, Chapter 2.
The council is designated as the administering agency for and is authorized to adopt regulations governing the following student aid programs in Title 23.1 of the Code of Virginia: the Two-Year College Transfer Grant Program (Chapter 6, Article 4), the Tuition Assistance Grant Act (Chapter 6, Article 5), the Virginia Guaranteed Assistance Program (Chapter 6, Article 6 and the Senior Citizens Higher Education Act (Chapter 6, Article 7). It has issued policies and guidelines, not listed herein, applicable primarily to publicly supported institutions of higher education for new degree programs, budget guidelines, domiciliary residence, and certain other student aid funds administered by state institutions of higher education.

No postsecondary educational institution, except certain religious institutions, may confer any college degree unless approved for such purpose by the council. Out-of-state institutions offering courses or programs in Virginia for academic credit are also required to obtain council approval. The council may exempt institutions or courses or programs, as provided for in the statute; prescribe standards for approval; and adopt regulations to carry out the statute.
