EDITOR’S NOTICE
Chapter 873 of the 2008 Acts of Assembly eliminated the interdepartmental regulation of children's residential facilities and group homes and required the Departments of Mental Health, Mental Retardation and Substance Abuse Services (now Behavioral Health and Developmental Services), Social Services, and Juvenile Justice to regulate and license such children's residential facilities and group homes for which they are the primary licensing agency. This act further provided that the Department of Education would be the sole entity responsible for licensure of educational programs in children's residential facilities and group homes.
Effective October 1, 2009, all regulations under VAC Agency No. 42 have been repealed. Refer to 6VAC35, 8VAC20, 12VAC35, and 22VAC40 for regulations of above-referenced agencies.
