Section 90. Noncompliance

A. An active member who has neither complied with the educational and reporting requirements of the Rule and this chapter, nor obtained a waiver or extension for good cause shown by July 31 of each reporting period, shall be subject to suspension of such active member's license to practice law as is provided by Paragraph 13.2 of Section IV, Part Six, Rules of Virginia Supreme Court.
B. In response to Paragraph 13.2 of Section IV, Part Six, Rules of Virginia Supreme Court, whenever the board determines that an active member has neither completed the mandatory continuing legal education requirements of the Rule and filed the certification required by 15VAC5-70-80 nor obtained a waiver or extension in accordance with 15VAC5-70-120 and 15VAC5-70-130, the member shall be deemed to be delinquent.
