Section 40. Definitions

  • As used in this chapter (14VAC5-110-10 et seq.):

    "Flesch reading ease score" means a measurement of the ease of readability of an insurance policy form made according to the procedures described in 14VAC5-110-50.

    "Member" means a person insured under a group policy but does not include the spouse or dependent of a member who may be covered under the group policy.

    "Nongroup basis" means a policy form issued to an individual regardless of how the insurance is marketed or premiums are paid.

    "Policy" or "policy form" means an insurance contract or agreement of accident and sickness insurance delivered or issued for delivery in this Commonwealth by any insurer subject to this chapter (14VAC5-110-10 et seq.); and includes all clauses, riders, endorsements and papers attached thereto. It shall also include any certificate issued under a group policy to groups with 10 or fewer members.
