Section 410. Change of ownership

  • A. Authorized retailers shall provide the state agency with advance written notice at least 15 calendar days prior to any change of ownership as outlined in 7 CFR 246.12.

    B. A change of ownership occurs when the principal owner, owners, or corporate officers of the business or corporation are legally or permanently changed.

    C. A retailer's authorization shall be terminated by the state agency upon a change of ownership. The rights and obligations established under a signed retailer's agreement with the WIC Program may not be transferred or assigned by the retailer or corporate owner to any other third party.

    D. The new owner or retailer manager of the business or corporation shall apply for WIC Program authorization and submit his qualifications and a new application for evaluation based on the most current retailer selection and authorization criteria.

    E. The state agency shall terminate the authorization status of any retailer that has undergone a change of ownership and failed to notify the state agency in accordance with the requirements outlined in the signed Retailer Agreement.
